Big Leaf Boutique Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of our website and purchases from Big Leaf Boutique (“we”, “us”, “our”). By placing an order or using our site, you agree to these Terms.

1. Our Business

Big Leaf Boutique sells plants online with delivery across Australia (subject to restrictions) or pickup from our farm at 108 Geles Rd, Upper Burringbar NSW 2483.

2. Orders and Pricing

All prices are in Australian dollars (AUD) and include GST unless stated otherwise. We reserve the right to correct pricing errors and refuse or cancel orders (e.g., due to stock issues). We will notify you promptly. Payment is required at the time of ordering. Orders are not processed until payment is cleared. You must provide accurate information. We are not responsible for delays due to incorrect details.

3. Consumer Guarantees and Our Goods

Under the Australian Consumer Law (ACL), our plants come with non-excludable consumer guarantees, including that goods are of acceptable quality, fit for purpose (as described), and match any sample or description.

Plant-specific notes (live plants are perishable and variable):

• Plants are living products. Size, appearance, and health can vary due to growing conditions, season, and natural variation. Images are indicative only.
• We guarantee plants are healthy and viable at dispatch. Our guarantee is limited (e.g., typically 7–30 days from delivery/pickup, at our discretion, and excludes issues from improper care, extreme weather, transit damage beyond our control, or planting errors).
• Claims must be made promptly with photos and details.
• Remedies may include replacement, refund, or credit (subject to ACL)
• Delivery costs for returns/replacements are generally at your expense unless the issue is our fault.

We cannot guarantee survival after delivery due to factors outside our control.

4. Delivery and Pickup

Delivery may be via third-party couriers. We are not responsible for delays, damage, or loss caused by the courier (subject to ACL). Risk passes to you upon dispatch (or pickup). Title passes upon full payment. Pickup is available by arrangement at the farm address. You must inspect plants at pickup. Delivery fees are calculated at checkout and are non-refundable except where required by law (e.g., faulty goods).

We may restrict delivery to certain areas (e.g., remote regions or states with biosecurity rules like WA). Check availability at checkout.

5. Refunds, Returns, and Cancellations

• Change of mind: Generally no refunds, subject to ACL consumer guarantees.
• Faulty or non-compliant goods: You may be entitled to a remedy (repair, replacement, refund) under ACL. Contact us promptly.
• Cancellations before dispatch may incur an administration fee. Once dispatched, returns are at your cost unless faulty.

All returns must be in original condition where possible. Refunds are processed to the original payment method.

6. Website Use and Intellectual Property

You must not misuse our site or content. All content (images, text) is our intellectual property or licensed to us. You may not reproduce without permission.
We may update the site and Terms. Continued use constitutes acceptance of changes.

7. Limitation of Liability

To the maximum extent permitted by law (including ACL), our liability is limited to the cost of the goods or re-supply of the goods. We are not liable for indirect or consequential losses (e.g., loss of profit, plant failure after proper care advice is ignored).

8. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Disputes are subject to the exclusive jurisdiction of NSW courts.

9. General

These Terms do not exclude, restrict, or modify any rights under the ACL or other laws that cannot be excluded.
If any part is unenforceable, the rest remains in effect.
We may vary these Terms by posting updated versions on the website.
